Estate Planning

Estate Planning & Litigation

We provide our clients with the resources and information they need to make the important decisions regarding their estate plan and work closely with them to design and estate plan that best suits their individual needs and circumstances.

We help our clients establish an estate plan to provide for the disposition of their assets. Depending on the circumstances, the estate plan may involve the preparation of a will, financial power of attorney, health care power of attorney, and/or a trust. A will and a trust both provide for the disposition of assets after death. But a trust has the advantage of avoiding the probate process. A financial power of attorney allows our clients to name someone to handle their property if they become incapacitated and a health care power of attorney allows our clients to appoint someone to direct their medical care if they are unable to do so for themselves.

Estate Administration

We assist our clients with the administration of property held in trust or in probate. This process known as “estate administration” generally involves the preservation and management of the property, the payment of debts and expenses, and the disposition of the assets. When the time comes to administer an estate, whether it be in a trust or through a probate proceeding, we work closely with our clients and their families to guide them through the process.

Estate Litigation

Unfortunately, there are times when conflicts arise regarding the administration of an estate. There may be contests of the will in probate, there may be objections to the distributions or other disposition of property from the estate, or any number of other differences of opinion between and among the beneficiaries of the estate. We work with our clients to resolve these conflicts outside of court if it is possible to do so, but if it is not we have the experience and knowledge to handle represent our client in trust and probate litigation cases.
