 We strive to avoid probate for our clients but if a probate is necessary we make strive to make the process as easy as possible for our clients. Probate is the legal process a person’s debts are paid and their assets distributed to their beneficiaries after their death. A will does not avoid probate but rather the will is the document “admitted to probate” directing how the decedent’s property should be distributed. If a person dies without a will, they are said to have died “intestate” and their property will be distributed as provided in the Arkansas intestacy statue. We prepare the documents necessary to probate the decedent’s estate, including the petition to file with the court to open the probate case, to notify beneficiaries and creditors, to pay the decedent’s debts and expenses, and for final distribution of the decedent’s estate.
