Guardianship

Guardianship & Planning for Incapacity

Guardian — Man and Child Walking in the Park in Fayetteville, AR
We assist our clients to avoid guardianship by the execution of financial powers of attorney and health care powers of attorney. Guardianship is the legal process by which a court appoints a guardian to manage the property and financial affairs and to make decisions regarding personal care and medical care for a person who is incapacitated and unable to do so for themselves. When that person has executed a financial power of attorney naming someone to manage their property and financial affairs, and a health care power of attorney naming someone to direct their personal and medical care, it should not be necessary to have a guardian or guardians appointed to do so during their incapacity.
If a guardianship is necessary, we help our clients through the process. We prepare the documents necessary to file in the guardianship case, including the petition to open the guardianship case and the required notifications. We assist the guardian or guardians in filing their annual reports and accountings with the court.

It is also possible to obtain both when the circumstances warrant a full guardianship.
